1.1 The Institute of Asset Management (“IAM”) asserts and retains full copyright of the Assessment Methodologies, “Self-Assessment Methodology” (“SAM”) and the “PAS 55 Assessment Methodology” (“PAM”) which consist of: Spreadsheet, Guidance and embodied Intellectual Property. These terms and conditions concern both methodologies.
2. Use of the Assessment Methodologies
2.1 The Assessment Methodologies have been published by and is the copyright of the IAM but you are hereby granted without charge a non-exclusive licence to download and exploit the Assessment Methodologies as described in this agreement provided that:
(a) the IAM is acknowledged as the source.
(b) our website address appears in some reasonably prominent related position (www.theIAM.org).
2.2 You may quote from the Assessment Methodologies and/or incorporate parts of the Assessment Methodologies in your own documents provided that:
(a) in all cases, you comply with the other parts of this agreement.
(b) you acknowledge clearly that the Assessment Methodologies have been published by and is the copyright of the IAM.
2.3 The following terms and conditions for use of the Assessment Methodologies apply in the following specific cases:
(a) by an Individual for Educational Purposes: You may download and use the Assessment Methodologies for your personal education and benefit including its use as part of organised and/or commercial training if you have up to date membership with the Institute of Asset Management (IAM).
(b) by an Individual on behalf of their Employer: A person (being a paid-up Individual Member of the IAM) may download and use the tools on behalf of their direct employer only (NOT other legal entities or organisations within a group) although the IAM prefers strongly that the employing organisation(s) become members and download the material in their own right.
(c) by a Corporate Member of the IAM: A client (being a paid-up Corporate Member of the IAM) may download and have the Assessment Methodologies used by a service provider (who may or may not be a paid-up Corporate Member of the IAM) because this constitutes use by the client. The service provider may not retain the material after the contracted services are concluded. (This is seen as tantamount to the client using the tool by means of temporary staff.)
(d) by an Endorsed Assessor: A (paid-up) IAM Endorsed Assessor may download and use the Assessment Methodologies on behalf of a client who may retain the outputs of this work. But the client may not retain the Assessment Methodologies tools or re-use the tool in any way by a service provider (who may or may not be a paid-up Corporate Member of the IAM) because this constitutes use by the client. But the service provider may not retain the material after the contracted services are concluded.

(e) by a Consultant or Service Provider: A service provider (being a paid-up Corporate Member of the IAM) may download and use the Assessment Methodologies on behalf of a client (who is not a paid-up Corporate Member of the IAM) – this may occur when doing a gap analysis, for example. The client may not retain the Assessment Methodologies material after the contracted services are concluded other than its output and information embedded in the service provider’s deliverables (in other words the client shall not thereafter be able to repeat the work / reuse the tools).
3. Resale and distribution of the Assessment Methodologies
3.1 The Assessment Methodologies themselves may not be sold or exploited for gain in whole or in part without the prior written authority of the IAM.
3.2 You shall not exploit the Assessment Methodologies or any part of it commercially nor sell any of its contents nor post them to any website or bulletin board nor transmit the Assessment Methodologies to other persons. If you have a proposal or wish to request such permission, please contact us by email at Office@theIAM.org.
3.3 You shall not include or distribute any of the Assessment Methodologies as part of a package with any other material of any description.
4. Translation of the Assessment Methodologies
4.1 The Assessment Methodologies may be translated into other languages as long as the copyright and source is unaffected and acknowledged prominently if you supply a copy of the Assessment Methodologies in any non-English language for our reference.
4.2 Meanings may thereby be compromised and English is always the reference language for ascertaining precise meanings. The IAM would prefer to collaborate with you if you wish to translate the Assessment Methodologies and we will acknowledge your contribution and distribute it to other users of the same language.
5.1 The IAM does not warrant the suitability or validity of the Assessment Methodologies for any purpose and will not accept any liability whatsoever for its use or incorporation by others and any real or alleged consequences.
5.2 The IAM will continuously amend and improve the Assessment Methodologies as and when evidence and feedback are available and deemed an improvement. Such changes and/or new versions will be made available to users who have registered and keep their details current.
